General Terms and Conditions (GTC)

1. Scope


1.1 These General Terms and Conditions (GTC) apply to all contracts concluded between Performance Plug Germany GbR (hereinafter referred to as "Provider") and the customer (hereinafter referred to as "Customer") via the Provider's online shop.

1.2 These terms and conditions apply to both consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB).

1.3 Any differing, conflicting or supplementary terms and conditions of the customer shall not become part of the contract unless the provider expressly agrees to them in writing.


2. Conclusion of the contract


2.1 The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

2.2 By clicking the order button, the customer submits a binding offer to purchase.

2.3 The contract is concluded by express order confirmation via e-mail or at the latest upon dispatch of the goods.

2.4 The provider reserves the right to refuse orders without giving reasons, especially in cases of suspected misuse or unclear solvency.


3. Prices and payment terms


3.1 All prices quoted are final prices including statutory VAT, if applicable.

3.2 Any additional shipping costs will be clearly displayed to the customer before the order is completed.

3.3 Accepted payment methods are:

  • PayPal

  • credit card

  • Klarna

  • Apple Pay / Google Pay

  • prepayment

    3.4 In case of late payment, the statutory provisions shall apply.


4. Delivery, shipping and transfer of risk


4.1 Delivery will be made within the delivery time specified in the online shop using a shipping service provider chosen by the supplier (e.g. DHL).

4.2 After shipment, the customer will receive – if available – a shipping confirmation with a tracking number.

4.3 For consumers, the supplier bears the shipping risk until the goods are actually handed over to the customer.

4.4 In the case of entrepreneurs, the risk passes to the customer upon handover of the goods to the shipping service provider.

4.5 Incorrect delivery addresses or failed deliveries for reasons attributable to the customer are at the customer's expense.


5. Cancellation before shipment


5.1 A free cancellation of the order is only possible within two (2) hours of receipt of the order confirmation .

5.2 After this period, cancellation can no longer be guaranteed, as the order is automatically processed, prepared, or already handed over to shipping.

5.3 The statutory right of withdrawal for consumers pursuant to point 6 remains unaffected.




6. Right of withdrawal



6.1 Consumers have a statutory right of withdrawal of 14 days from receipt of the goods, provided that none of the following exclusion grounds apply.


6.2 The cancellation must be made by sending a clear statement to the provider via email or post.


6.3 The customer shall bear the direct costs of returning the goods.


6.4 The right of withdrawal does not apply to contracts for the supply of goods,


  • which were custom-made or personalized,
  • which were delivered sealed, provided the seal was removed after delivery,
  • which were fully provided as part of services,
  • which were installed, fitted or electrically connected after delivery and, due to their nature, can no longer be restored to their original condition.



This applies in particular to electronic modules, control units or other technical products that have been integrated into a vehicle.

In these cases, a revocation is excluded in accordance with § 312g para. 2 of the German Civil Code (BGB).


7. Retention of title


The goods remain the property of the supplier until full payment has been received.


8. Warranty


8.1 The statutory warranty rights apply.

8.2 For entrepreneurs, the warranty period is 12 months from the transfer of risk, insofar as legally permissible.

8.3 Obvious defects must be reported immediately upon receipt of the goods.


9. Disclaimer of liability for consequential damages in vehicle electronics


9.1 The products offered by the supplier, in particular electronic modules, control unit extensions and CAN bus-related components, interfere with existing electronic vehicle systems.


9.2 The provider is not liable for consequential damages , in particular for damages to:

  • Control units (e.g. ECU, BCM, FRM, FEM, BDC)

  • CAN bus or LIN bus systems

  • On-board electronics, sensors or actuators

  • Vehicle software, coding, or control unit configurations

  • other electrical or electronic vehicle components


9.3 This applies in particular to:

  • improper or faulty installation

  • Installation by non-qualified persons

  • faulty coding or software adaptation

  • Use in unapproved vehicle models

  • Use of non-standard or modified vehicle software


9.4 Installation is at the customer's own risk . The supplier expressly recommends installation by a qualified specialist workshop.


9.5 Liability for indirect damages, consequential damages, loss of use, reduction in the value of the vehicle or other financial losses is excluded to the extent permitted by law.


9.6 Liability for intent and gross negligence remains unaffected.


10. Special provisions for tuning parts


10.1 Many of the products offered are intended for motorsport, show or off-road purposes and may not be approved for use on public roads .

10.2 The customer is responsible for complying with the legal regulations (e.g. StVZO).

10.3 The provider accepts no liability for unauthorized use in public road traffic.


11. Data protection


Personal data is processed in accordance with applicable data protection regulations. Further information can be found in the online shop's privacy policy.


12. Dispute Resolution


The EU Commission provides a platform for online dispute resolution (ODR).

The provider is neither obligated nor willing to participate in a dispute resolution procedure.


13. Disclaimer for external links


The provider assumes no responsibility for the content of external websites linked to from this site.


14. Final Provisions


14.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

14.2 The contract language is German.

14.3 Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
